La responsabilidad por ríesgo no es más que la aplicación de la teoría del riesgo a la responsabilidad civil extracontractual. Como prolegómeno, baste decir que la entrada al mundo jurídico de la teoría del riesgo sirvió para poner en jaque a la dogmática y milenaria culpa como fundamento de la responsabilidad civil, fue el primer criterio objetivo de imputación y sin duda alguna el centro de los más polémicos debates entre los partidarios de la culpa y los partidarios de la (...) responsabilidad civil ausente de toda idea de culpa. La mayoría de la doctrina se refieren a la responsabilidad objetiva o por riesgo, cosa que no es cierta porque el riesgo no es el único criterio objetivo de imputación. (shrink)

Verdad, justicia y reparación, son conceptos que en los últimos años han aparecido en el panorama jurídico penal colombiano, para hacer referencia a los derechos que tiene la víctima de un delito y no ya únicamente derecho a la reparación económica. Si bien expresamente la ley 906 se refiere a esos tres derechos, sus efectos prácticos son de aplicación relativa, ya que en muchas ocasiones no se logra establecer la verdad, no se hace justicia y no se logra la reparación. One of the great problems of caregivers and health professionals in recent times has been the so-called compassion fatigue and its association with burnout syndrome. Another pole of compassion has been described in terms of compassion satisfaction. Both propositions could be problematic in the caregiving setting. This is an analytical reflective article that through an apparent aporia tries to problematize and propose a theoretical synthesis that allows to denote compassion as a virtue in Aristotelian terms. To this end, it resorts (...) to etymologies, translations and mainly to the classical theoretical references regarding compassion fatigue, compassion satisfaction and, of course, Aristotelian ethics. This is a theoretical bet that leaves open the discussion regarding the dichotomies compassion fatigue and compassion satisfaction; apathy and hyperpathy; and proposes to rethink compassion as a virtue, a reasoned middle ground, contextualized in the framework of care between two possible excesses. Es un análisis y reflexión sobre la normalización de la crisis como un ejercicio del biopoder, sus posibles consecuencias y formas de resistencia. Todo ello, en el marco contextual de la pandemia por el virus SARS-Cov-2, se toman como principales referentes conceptuales a Michel Foucault, Hans Jonas y Jared Diamond. Se hace una lectura de la teoría foucaultiana del poder para abordar la relación entre normalización de la crisis y el biopoder. Las propuestas de Diamond y Jonas se ponen en (...) un marco dialógico interpretativo, a través del cual se pretende dar un enfoque crítico responsivo ante la situación actual, desde una postura que toma el miedo, no como un factor paralizador y aturdidor, sino como un agente movilizador que obliga a pensar, reflexionar y, con ello, a poder responder, ampliar los círculos de compasión y empatía para cuidar de la vida en una casa común y resistir ante la normalización del biopoder. En este trabajo ofrecemos un panorama al estudio de los sesgos. El creciente interés en ellos durante las últimas décadas radica en que estudiarlos implica hablar de cómo los seres humanos razonamos y emitimos juicios, e igualmente sobre los mecanismos y procesos que subyacen a tales capacidades, esto incluye entender cuándo y por qué frecuentemente nos equivocamos, como lo indica buena parte de la literatura en psicología cognitiva del razonamiento. Dada la existencia de los sesgos, han surgido posturas pesimistas que (...) sostienen que los sesgos muestran que los humanos son irracionales. Frente a estas, la literatura reciente ofrece visiones mas optimistas, y aduce que los sesgos pueden “desaparecer” si se tienen en consideración diferentes aspectos de tipo evolutivo. Otra postura es aquella que sostienen que la supervivencia humana no yace en la inteligencia individual sino en la colectiva. Es decir, que podemos dejar de confiar exclusivamente en el contenido de nuestra mente y en su lugar resolver los problemas colectivamente, gracias a la división de las tareas cognitivas. Para organizar la exposición dividimos el trabajo en tres enigmas de los sesgos cognitivos. El primero consiste en una discusión sobre el origen de los sesgos. El segundo concierne a su clasificación e inventarios. El tercer enigma versa sobre la unidad de análisis de la cognición humana, a saber, inteligencia individual versus inteligencia colectiva. Con estos enigmas queremos poner de manifiesto el abanico de discusiones que giran alrededor de los sesgos, sus problemas, así como la creciente fascinación por entenderlos. Estudiar los sesgos abona a la comprensión de cómo razonamos o pensamos, y esto nos ayuda a mejorar nuestro pensamiento crítico. (shrink)

El artículo aborda la pandemia del covid-19 como elemento contingente y su efecto de develamiento respecto de algunas manifestaciones contemporáneas de la ideología neoliberal en Latinoamérica. De esta forma, en base a conceptos filosóficos y psicoanalíticos de orientación lacaniana planteados fundamentalmente por Slavoj Žižek, se examinan los usos críticos de la noción de ideología en sus diversas manifestaciones: miedo al otro, imposición de la lógica del empresario de sí, destrucción de lazos sociales, extractivismo de recursos naturales y fetichización de los (...) discursos de unidad frente a la pandemia. La hipótesis radica en que la pandemia presenta una oportunidad para repensar la subjetividad contemporánea, mediante la confrontación con el Real que bordea a la simbolización y, en definitiva, a la captura ideológica, a fin de poner en cuestión la afirmación de que no hay alternativa. Each of these two kinds of dependence of truth on the world corresponds to one of the dimensions on the two-dimensional semantic framework, developed in the 1970’ (...) in the work of Evans, Kaplan, Kripke and Stalnaker. The introduction provides a systematic overview of the framework, the ideas of its earlier originators, recent developments and criticism. A filosofia da linguagem dedica-se ao estudo da linguagem natural. Não se dedica ao estudo de línguas particulares, tal como o português, o castelhano ou o inglês, mas sim ao estudo filosófico de características gerais da linguagem e da nossa capacidade e proficiência linguística enquanto seres humanos. A investigação do desenvolvimento da linguagem é uma tarefa a ser desenvolvida pela ciência – a paleontologia, a neurologia, etc. Mas a ciência ocupa-se de algo de que temos um conhecimento intuitivo prévio – (...) a linguagem natural. Ora, a filosofia da linguagem dedica-se em parte a tornar explícito o nosso conhecimento implícito da linguagem. Como tal, a filosofia da linguagem é uma disciplina central na filosofia. Este capítulo é uma introdução selectiva à filosofia da linguagem. A alternativa que se nos deparava era fazer uma breve apresentação de teorias do significado, da referência e da verdade, e ainda de alguns tópicos de pragmática, ou escolher um tópico em particular que é, tradicionalmente, o elegido nos cursos introdutórios à filosofia da linguagem. Este capítulo oferece assim uma introdução a alguns dos temas centrais e clássicos da filosofia da linguagem contemporânea. A maior parte do capítulo dedicar-se-á a teorias da referência, a de Frege e de Russell, e à sua crítica subsequente por filósofos como Saul Kripke. Isto poderia levar-nos a pensar que a filosofia da linguagem contemporânea continua, como era tradicional, focada simplificada da relação entre linguagem, mente e mundo. Nada podia estar mais longe da verdade, como se tornará claro. A grande alteração na perspectiva sobre o estudo da linguagem, que se deve a pessoas como Frege ou Russell, é que graças ao seu trabalho os filósofos passaram a reflectir sobre a contribuição semântica sistematicamente feita por diferentes categorias sintácticas nas diferentes construções frásicas em que possam ocorrer, por exemplo a de termos referenciais como os nomes próprios. A relação linguagem-mente-mundo continua a ser uma preocupação dos filósofos contemporâneos, mas de uma forma muito mais sofisticada, rigorosa e sistemática. Os filósofos preocupam-se agora, por exemplo, com as condições de verdade correctas de usos particulares de frases, com os estados de coisas reais ou possíveis que confeririam verdade ou falsidade às frases usadas, e com o valor cognitivo de distintos tipos de frases. Como indicaremos na última secção do capítulo, outros desenvolvimentos da filosofia da linguagem contemporânea dizem respeito àquilo que nós, enquanto seres humanos, conseguimos fazer por meio da linguagem, aos diferentes actos de fala possíveis, e aos diferentes níveis de significado que podemos comunicar por meio do uso de frases com um significado convencionalmente estabelecido. Denialism concerning free will and moral responsibility combines, in its minimal form, the rejection of libertarian free will and the rejection of compatibilism. I will address the more ambitiously “happy” or “optimistic” version of denialism, which also claims that we are better off without belief in free will and moral responsibility, and ought to try to radically reform our moral, social and personal lives without such beliefs. I argue that such denialism involves, for various reasons, a dangerous gamble, which it (...) would be morally irresponsible to follow. I conclude by reflecting upon the implications. (shrink)

As the premier early modern advocate of an Epicurean alternative to the prevailing neo-Scholastic framework of Aristotelianism, Pierre Gassendi promoted not only ancient but also innovative reasoning on behalf of atomism, probabilism, empiricism, psychological hedonism, social contractarianism, and a range of other stances associated with the philosophy of the Garden. Much commentary has focused on the extent to which Gassendi ‘baptizes’ Epicurean thought. Beyond this aspect of his Epicureanism are questions as to whether, and how, Gassendi is true to core (...) Epicurean thinking, and what he preserves and promotes as valuable to philosophical and natural investigations of his time. Indeed, much subsequent modern philosophy builds on or reacts to an Epicurean legacy bequeathed by Gassendi, comprising his adjustments to, constraints on, or corrections of, the canonical views. Yet, for all his amendments, he retains as a primary philosophical motivation the Epicurean goal of striving for ataraxia. In this, he signals his firm commitment to philosophy in the tradition of the canonical Epicurean views. And, as with Epicurus’ own notion, his account of the centrality of attaining tranquility directs us to a better understanding of our nature and that of the world around us; amenable, in Gassendi’s framework, to Christian thought and contemporary natural philosophical investigations. This essay explores the speech act of dogwhistling (sometimes referred to as ‘using coded language’). Dogwhistles may be overt or covert, and within each of these categories may be intentional or unintentional. Dogwhistles are a powerful form of political speech, allowing people to be manipulated in ways they would resist if the manipulation was carried outmore openly—often drawing on racist attitudes that are consciously rejected. If philosophers focus only on content expressed or otherwise consciously conveyed they may miss what is (...) most powerful and pernicious in the speech of political culture. This essay is a call to start paying attention to these more covert speech acts, and a first attempt at beginning to theorize them. It argues that dogwhistles present a complex and interesting case for the philosopher of language, and explores their implications for democratic politics. (shrink)

Albert and De Ruiter provide an introduction to the Conversation Analytic approach to ‘repair’: the ways in which people detect and deal with troubles in speaking, hearing and understanding in conversation. They explain the basic turn‐taking structures involved, provide examples, explain recent developments in the field and highlight some important points of contact and contrast with work in the Cognitive Sciences.

In 2017, the National Prosecution Bureau of Chile created the Special Unit for Human Rights, Gender-Based Violence, and Sex Crimes, becoming a milestone for criminal prosecution policies as the first time a state institution in Chile used the term ‘gender-based violence’ explicitly in its title. There was no law in the country that addressed and sanctioned this behaviour—recognising it as a social phenomenon—at the time of the Unit's creation. What does the creation of this new Unit mean for access to (...) justice from a gender perspective? To answer this question, we have critically analysed the creation of this Unit as a case study from a feminist institutionalist standpoint. We found that this institutional change might bring a broadening in access to justice for women, girls and LGBTQI+ persons by implementing a gender perspective. (shrink)

In a wide-ranging, provocative anatomy of modern society and its origins, novelist and historian John Ralston Saul explores the reason for our deepening sense of crisis and confusion. Throughout the Western world we talk endlessly of individual freedom, yet Saul shows that there has never before been such pressure for conformity. Our business leaders describe themselves as capitalists, yet most are corporate employees and financial speculators. We are obsessed with competition, yet the single largest item of international trade is a (...) subsidized market in armaments. We call our governments democracies, yet few of us participate in politics. We complain about "invasive government," yet our legal, educational, financial, social, cultural and legislative systems are breaking down. The notion of social progress is not much in favour in these sophisticated times of scepticism, cynicism, relativism and political correctness; at least in the West. Most people might admit that some indubitable advances have occurred, primarily in terms of this or that useful technological innovation. But any wider claim about ‘social progress’ is often met by overwhelming doubt and suspicion, if not outright derision. I provide a short argument for belief in progress.

We give $A_p$ type conditions which are sufficient for two-weight, strong $$ inequalities for Calderón-Zygmund operators, commutators, and the Littlewood-Paley square function $g^*_\lambda $. Our results extend earlier work on weak $$ inequalities in [13].

The general concept of a trope – that of a non-shareable character-grounder – admits of a distinction between modifier tropes and module tropes. Roughly, a module trope is self-exemplifying whereas a modifier trope is not. This distinction has wide-ranging implications. Modifier tropes are uniquely eligible to be powers and fundamental determinables, whereas module tropes are uniquely eligible to play a direct role in perception and causation. Moreover, each type of trope theory faces unique challenges concerning character- grounding. Modifier trope theory (...) faces challenges concerning the inscrutability of predication and the incompatibility with bundle theory, whereas module trope theory faces challenges concerning character overdetermination and a collapse into austere nominalism. These differences indicate that the modifier/module distinction divides the advantages of general trope theory and thus presents the trope theorist with a pivotal choice. (shrink)

Este trabajo es el resultado de una investigación que se hizo con estudiantes del grado undécimo bachillerato del colegio rural Pozo Nutrias Dos, del municipio de San Vicente del Chucuri, del departamento de Santander, Colombia. Consistió en indagar por cómo una propuesta pedagógica favorece la lectura crítica de textos filosóficos en la institución educativa. En ese sentido para su desarrollo se planteó como objetivo general el caracterizar una propuesta pedagógica para la lectura crítica de textos filosóficos en la institución, junto (...) con los objetivos específicos de identificar las prácticas lectoras de los estudiantes de undécimo en la asignatura de Filosofía, indagar por el concepto que tienen de lectura crítica estudiantes del grado undécimo y los docentes de Lenguaje de la institución y por último, caracterizar los textos filosóficos que permiten el accionar de una propuesta pedagógica frente a la lectura crítica de textos filosóficos en el aula. En cuanto al aspecto metodológico se recurre al paradigma cualitativo y al diseño de investigación acción en educación dentro del contexto de la maestría en Pedagogía ofertada por la UIS. (shrink)

What place, if any, does love have in Kantian ethics? This chapter is divided into three parts. First, I discuss Kant’s own account of moral versus non-moral love as found throughout his various writings and show how this closely parallels his account of moral versus non-moral friendship. Second, I discuss contemporary Kantian accounts of both friendship and love, highlighting how they go beyond, and in some ways seem to significantly improve upon, Kant’s own views via their appeal to Kant’s Formula (...) of Humanity. Lastly, I discuss the overall merits of what I call ‘Kantian moral love’. I argue that while Kantian moral love might rightly identify, from the moral point of view, how we ought to act and think when loving other people, it fails to provide a complete account of love, crucially leaving out certain key elements from the wide range of loving relationships we find ourselves in, especially romantic love. That is, while Kantian moral love might successfully identify a morally ideal way to love other people, it falls short of capturing the full essence of love—mainly because love is not simply a moral affair but also a matter of the heart. A formal theory of truth, alternative to tarski's 'orthodox' theory, based on truth-value gaps, is presented. the theory is proposed as a fairly plausible model for natural language and as one which allows rigorous definitions to be given for various intuitive concepts, such as those of 'grounded' and 'paradoxical' sentences.

Reference and Existence, Saul Kripke's John Locke Lectures for 1973, can be read as a sequel to his classic Naming and Necessity. It confronts important issues left open in that work -- among them, the semantics of proper names and natural kind terms as they occur in fiction and in myth; negative existential statements; the ontology of fiction and myth. In treating these questions, he makes a number of methodological observations that go beyond the framework of his earlier book -- (...) including the striking claim that fiction cannot provide a test for theories of reference and naming. In addition, these lectures provide a glimpse into the transition to the pragmatics of singular reference that dominated his influential paper, " Speaker's Reference and Semantic Reference " -- a paper that helped reorient linguistic and philosophical semantics. Some of the themes have been worked out in later writings by other philosophers -- many influenced by typescripts of the lectures in circulation -- but none have approached the careful, systematic treatment provided here. The virtuosity of Naming and Necessity -- the colloquial ease of the tone, the dazzling, on-the-spot formulations, the logical structure of the overall view gradually emerging over the course of the lectures -- is on display here as well. Max Stirner was one of the most important and seminal thinkers of the mid-nineteenth century. In the shadows of Hegel, Stirner developed possibly the most radical and devastating critique ever of the discourses of modernity, incurring the ire of Marx, prefiguring Nietzsche, and having a major (though often unacknowledged) impact on diverse streams of thought, from existentialism to anarchism and autonomism, literary and artistic avant-gardes, and postmodern theory. This edited volume investigates Stirner's impact on critical thinking and social and political (...) thought, exploring his radical and contemporary importance as a political theorist. In unmasking the religiosity lurking behind discourses of humanism and rationalism, and the domination of the individual immanent within liberal modes of politics, Stirner demolished the ontological foundations and universal grand narratives of our modernity.
